Happy Remedy is not responsible for injury or damage resulting from intentional misuse, use contrary to product instructions or warnings, unauthorized modification of a product, or use of a product after it has been improperly stored or materially altered after delivery, to the extent permitted by applicable law.

Nothing in these Terms limits rights or remedies that cannot legally be limited.

Section 9 — Intellectual Property

The Services and their contents, features, and functionality—including, without limitation, Happy Remedy's names, logos, trademarks, slogans, product names, product packaging designs, graphics, photographs, videos, text, website design, illustrations, and other content—are owned by or licensed to Happy Remedy Inc. and are protected by applicable intellectual property laws.

If you voluntarily submit a product review, testimonial, photograph, video, comment, suggestion, idea, or other content to Happy Remedy (“User Content”), you represent that you own the content or otherwise have the necessary rights and permissions to submit it.

You grant Happy Remedy a non-exclusive, worldwide, royalty-free, transferable, and sublicensable license to use, reproduce, publish, display, distribute, adapt, and otherwise use the User Content in connection with our business, products, website, advertising, social media, and marketing, subject to applicable law.

You retain ownership of any rights you otherwise hold in your User Content.

PRODUCT RESULTS AND EXPERIENCES MAY VARY FROM PERSON TO PERSON.

TO THE FULLEST EXTENT PERMITTED BY LAW, HAPPY REMEDY DISCLAIMS IMPLIED WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, EXCEPT TO THE EXTENT SUCH WARRANTIES CANNOT LEGALLY BE DISCLAIMED.

NOTHING IN THESE TERMS EXCLUDES OR LIMITS ANY WARRANTY, RIGHT, OR REMEDY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

Section 18 — Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, HAPPY REMEDY INC. AND ITS DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICES OR PRODUCTS, INCLUDING LOST PROFITS, LOST REVENUE, LOST DATA, OR SIMILAR LOSSES.

THESE LIMITATIONS DO NOT APPLY TO LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

SOME STATES OR JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OR EXCLUSIONS OF LIABILITY. IN THOSE JURISDICTIONS, THESE LIMITATIONS WILL APPLY ONLY TO THE MAXIMUM EXTENT PERMITTED BY LAW.

You may not assign or transfer your rights or obligations under these Terms without our prior written consent.

Happy Remedy may assign or transfer its rights and obligations under these Terms in connection with a merger, acquisition, reorganization, financing, sale of assets, or other business transaction, or as otherwise permitted by law.

These Terms and any dispute arising out of or relating to these Terms or the Services will be governed by the laws of the State of California, without regard to conflict-of-law principles, except where applicable law requires otherwise.

Subject to any rights you may have under applicable consumer-protection law, any legal proceeding arising out of or relating to these Terms or the Services shall be brought in a court of competent jurisdiction in Los Angeles County, California, unless applicable law requires a different forum.

Nothing in this section limits any consumer right that cannot legally be waived.

Section 26 — Text Messaging (SMS) Terms

The Happy Remedy mobile message service (the "Service") is operated by Happy Remedy Inc. ("Happy Remedy", "we", or "us"). Your use of the Service constitutes your agreement to these terms and conditions ("Mobile Terms"). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

By consenting to Happy Remedy's SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Happy Remedy through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).

You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Happy Remedy. Your participation in this program is completely voluntary.

This program is available to users in the United States who are 18 years of age or older.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

You may opt-out of the Service at any time. Text the single keyword command STOP to +1 (855) 506-7685 or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Happy Remedy mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.
